Image usage agreement
Etre operates this section of the Web Site, entitled "Images", for you to view, download and comment on images ("Images") of Etre Touchy gloves as part of your job in the press and/or as an industry analyst or blogger.
These terms and conditions only apply to your use of the Images and are supplemental to the Terms. In the event of any conflict between these terms and conditions and the Terms, these terms and conditions shall prevail.
You may use the Images solely for editorial use in the course of your work in the press and/or as an industry analyst or blogger. This right to use the Images is personal to you and is not transferable by you to another party. The Images cannot be used to promote or sell any product or technology (such as on advertising, brochures, book-covers, stock photos, t-shirts, or other promotional merchandise), including the gloves themselves, without Etre's prior written permission. You may not alter, or modify the Images, in whole or in part, for any reason.
As between you and Etre, Etre is and shall remain either the sole and exclusive owner or, where Etre has obtained rights to use the Images from third party licensors, permitted licensee of the Images. You shall not delete, alter, or obfuscate any proprietary notices or marks relating to the Images, and each use will be accompanied by an applicable proprietary attribution shown next to the Image. For example: "Courtesy of Etre".
The Images are provided by Etre on an 'as is' basis, without warranty of any kind, either express or implied, to the fullest extent permissible pursuant to applicable law including (but not limited to) non-infringement or ownership. You, not Etre, are responsible for your use of the Images. You acknowledge and agree that any misuse of the Images or breach of these terms and conditions may cause Etre irreparable harm. If you breach any of these terms and conditions your right to use the Images terminates automatically.
